LUBBOCK, TX

Jay and Stephanie Ganaway of Plainview sued Lubbock attorney Tommy Turner and his law firm, Turner & Jordan, on Thursday for $1 million or more.

According to the lawsuit, the Ganaways filed a lawsuit against Covenant Children’s Hospital claiming an injury of their child during a hospital stay in late 2011.

However, the case was ultimately thrown out of court, according to the lawsuit, after the law firm failed to make a designation of expert witnesses within a deadline set by the court.

The new lawsuit on Thursday said, “Turner did not disclose to the Gannaways that he had missed any summary judgment deadline and, instead, affirmatively represented to them that everything had been timely filed.”

The lawsuit against Turner & Jordan said the law firm was negligent by “failing to diligently represent Plaintiffs.”

A message was left for Tommy Turner by phone on Friday afternoon. If he chooses to make a statement, this story will be updated.

Turner and the law firm have not yet filed their side of the story in court records. A follow up will be provided when the law firm files its side of the story in court.
